\nNENI 22. \u201cJan\u00eb shtetas shqiptar\u00eb t\u00eb gjith\u00eb ata q\u00eb kan\u00eb lindur ose q\u00eb jan\u00eb vendosur n\u00eb Shqip\u00ebri p\u00ebrpara 28 n\u00ebntorit t\u00eb 1912-s dhe q\u00eb, n\u00ebn qeverin\u00eb osmane kan\u00eb pasur n\u00ebnshtet\u00ebsin\u00eb osmane\u201d.<\/p>\n

P\u00ebr t\u00eb zbatuar nj\u00eb norm\u00eb juridike, duhet q\u00eb n\u00eb radh\u00eb t\u00eb par\u00eb, t\u00eb kuptohet q\u00ebllimi q\u00eb k\u00ebsaj norme ka pasur n\u00eb mend (dhe dashur) t\u2019i jap\u00eb legjislatori.
\nInterpretimi i nj\u00eb norme juridike, n\u00eb baz\u00eb t\u00eb kontekstit t\u00eb saj, mund t\u00eb jet\u00eb i \u201cngusht\u00eb\u201d ose i \u201czgjeruar\u201d. Po ashtu, ky interpretim, mund t\u00eb jet\u00eb autentik (i legjislatorit), gjyq\u00ebsor (i gjykat\u00ebsit) dhe doktrinor (i studjuesit t\u00eb drejt\u00ebsis\u00eb).<\/p>\n

INTERPRETIMI JURIDIK<\/strong>.<\/p>\n

1. Varianti turk. Nuk ka interpretim juridik, pasi pranohet ashtu si\u00e7 lexohet! Jo vet\u00ebm n\u00eb k\u00ebt\u00eb rast (…..)!
\nDisa variante juridike shqiptare<\/p>\n

2. Neni 22 i referohet:
\na. Shqiptar\u00ebve \u201cq\u00eb kan\u00eb lindur n\u00eb Shqip\u00ebri\u201d (musliman\u00eb synit\u00eb, katolik\u00eb apo ortodoks\u00eb). Nuk besoj se ndonj\u00eb shqiptar katolik (p\u00ebrfshir\u00eb dukagjinsit dhe mirditor\u00ebt katolik\u00eb) do preferonte q\u00eb t\u00eb konsiderohej dhe t\u00eb trajtohej si turk me komb\u00ebsi;<\/p>\n

b. Ata (pa p\u00ebrcaktim, pasi n\u00eb rast t\u00eb kund\u00ebrt, lista do dilte shum\u00eb e gjat\u00eb) \u201cq\u00eb jan\u00eb vendosur n\u00eb Shqip\u00ebri\u201d, t\u00eb cil\u00ebt mund t\u00eb ishin turq, armen\u00eb, uzbek\u00eb, taxhik\u00eb, gjeorgjian\u00eb, kinez\u00eb ujgur\u00eb, arixhinj, gabel\u00eb, etj. Data KUFI \u00ebsht\u00eb 28 n\u00ebntori. Pra, k\u00ebt\u00eb dat\u00eb KUFI detyrohet prej hallit q\u00eb ta pranoj\u00eb edhe vet\u00eb Turqia. Q\u00eb do t\u00eb thot\u00eb, se turku e njihte dhe se duhej t\u00eb \u201cm\u00ebsohej\u201d me realitetin e ri: Shtetin e Ri Shqiptar.
\n4. Jan\u00eb shqiptar\u00eb. Gjendje faktike, e cila pranohet. KUSH?<\/p>\n

– \u201cT\u00eb gjith\u00eb ata q\u00eb kan\u00eb lindur n\u00eb Shqip\u00ebri\u201d. Q\u00eb do t\u00eb thot\u00eb, se kush lindte n\u00eb Shqip\u00ebri, pavar\u00ebsisht n\u00ebse kishte prind\u00ebr shqiptar\u00eb, apo t\u00eb huaj, si serb, grek, maqedon, turq, armen, taxhik, kinez ujgur, arab, arixhi, gabel, etj., \u00ebsht\u00eb shqiptar me n\u00ebnshtet\u00ebsi. Por, q\u00eb p\u00ebrve\u00e7 n\u00ebnshtet\u00ebsis\u00eb shqiptare mund t\u00eb ket\u00eb edhe n\u00ebnshtet\u00ebsin\u00eb turke. Normal. N\u00eb k\u00ebt\u00eb rast, n\u00ebnshtet\u00ebsia shqiptare, lihet m\u00eb shum\u00eb t\u00eb kuptohet indirekt, kurse ajo turke shprehet qart\u00ebsisht. Q\u00eb do t\u00eb thot\u00eb se n\u00ebse nj\u00eb serb, grek, maqedon, turq, armen, taxhik, kinez ujgur, arab, arixhi, gabel, etj. \u00ebsht\u00eb vendosur n\u00eb Shqip\u00ebri, at\u00ebher\u00eb ai merr automatikisht n\u00ebnshtet\u00ebsin\u00eb shqiptare. P\u00ebrve\u00e7 asaj turke, q\u00eb e kishte t\u00eb garantuar paraprakisht kur vendosej n\u00eb Shqip\u00ebri. \u00cbsht\u00eb nj\u00eb lloj shp\u00ebrbimi n\u00eb k\u00ebt\u00eb rast. Jo vet\u00ebm si n\u00ebnshtet\u00ebsi, por edhe si pasuri apo ofi\u00e7e t\u00eb ndryshme!<\/p>\n

Pasi pak kush do pranonte q\u00eb t\u00eb humbiste n\u00ebnshtet\u00ebsin\u00eb serbe, greke, maqedonase, turke, armene, taxhike, kinezo ujgure, arabe, gabele(!), p\u00ebr t\u00eb sakrifikuar, duke l\u00ebn\u00eb vendin e tij t\u00eb begat\u00eb, p\u00ebr t\u2019u vendosur n\u00eb Shqip\u00ebri, pa pasur m\u00eb par\u00eb n\u00ebnshtet\u00ebsin\u00eb e madh\u00ebrishme osmane. P\u00ebrve\u00e7 asaj shqiptare, edhe n\u00eb shenj\u00eb \u201csolidariteti\u201d me banor\u00ebt autokton\u00eb mijevje\u00e7ar\u00eb. P\u00ebrs\u00ebri dy n\u00ebnshtet\u00ebsi.<\/p>\n

– \u201cDHE\u201d. Cili \u00ebsht\u00eb kuptimi i lidh\u00ebzes DHE? Jan\u00eb shqiptar\u00eb ata persona q\u00eb plot\u00ebsojn\u00eb kushtet m\u00eb lart \u2013 pra lindjen dhe vendosjen n\u00eb Shqip\u00ebri \u2013, por DHE q\u00eb \u201cn\u00ebn qeverin\u00eb osmane kan\u00eb pasur n\u00ebnshtet\u00ebsin\u00eb osmane\u201d. Sigurisht, pasi n\u00ebn qeverin\u00eb osmane, nuk mund t\u00eb mos e kishe n\u00ebnshtet\u00ebsin\u00eb osmane. Edhe nj\u00ebher\u00eb dy n\u00ebnshtet\u00ebsi.<\/p>\n

INTERPRETIM GJUH\u00cbSOR<\/strong>.<\/p>\n

T\u00eb shpall\u00ebsh sikur ke zbuluar di\u00e7ka t\u00eb rrall\u00eb, duke th\u00ebn\u00eb \u201cJa pse shqiptar\u00ebt, para se t\u00eb ishin shqiptar\u00eb ishin osman\u00eb\u201d, do t\u00eb thot\u00eb se shqiptar\u00ebt ishin m\u00eb par\u00eb osman\u00eb dhe pas vitit 1912 (si me magji ata u b\u00ebn\u00eb shqiptar\u00eb!). Por, n\u00ebse do ishte k\u00ebshtu, at\u00ebher\u00eb neni 22 duhej shkruar: \u201cB\u00cbHEN shtetas shqiptar\u00eb t\u00eb gjith\u00eb ata, etj.\u201d. Dhe n\u00ebse do shkruhej \u201cb\u00ebhen\u201d, at\u00ebher\u00eb natyrisht kuptohet se pa u b\u00ebr\u00eb shqiptar\u00eb ata (PAS 28 n\u00ebntorit 1912), kan\u00eb qen\u00eb osman\u00eb (PARA 28 n\u00ebntorit 1912). Por, neni 22 thot\u00eb se: \u201cJAN\u00cb shtetas shqiptar\u00eb t\u00eb gjith\u00eb ata, etj.\u201d.<\/p>\n

Dallimi mes foljes \u201cJAN\u00cb\u201d dhe \u201cB\u00cbHEN\u201d.<\/p>\n

– N\u00eb rastin e foljes \u201cJAN\u00cb\u201d, verifikohet nj\u00eb situat\u00eb, ose nj\u00eb vazhdim\u00ebsi formale e thelb\u00ebsore, duke p\u00ebrdorur koh\u00ebn e tashme, vet\u00ebn e tret\u00eb shum\u00ebs t\u00eb foljes ndihm\u00ebse JAM.<\/p>\n

– N\u00eb rastin e fojes \u201cB\u00cbHEN\u201d, ndodhemi para nj\u00eb ndryshimi formal e thelb\u00ebsor dhe p\u00ebrdoret koha e tashme e diatez\u00ebs p\u00ebsore t\u00eb foljes B\u00cbJ.<\/p>\n

P\u00cbRFUNDIM<\/strong>.<\/p>\n

Norma m\u00eb lart q\u00eb u analizua, \u00ebsht\u00eb nj\u00eb norm\u00eb PERCEPTIVE, pra norm\u00eb q\u00eb perceptohet dhe merret ashtu si\u00e7 \u00ebsht\u00eb shkruar. Q\u00eb do t\u00eb thot\u00eb se njihet (edhe) nj\u00eb realitet paraekzistues dhe jo pasekzistues. Dhe kjo, fal\u00eb foljes ndihm\u00ebse JAM.<\/p>\n

Por, kjo norm\u00eb mund t\u00eb ishte programatike, pra do t\u00eb jepte nj\u00eb orientim apo detyrim p\u00ebr t\u00eb ndryshuar di\u00e7ka, vet\u00ebm po t\u00eb kishte foljen me diatez\u00eb p\u00ebsore B\u00cbHEM, ose foljen ndihm\u00ebse DUHET (DO T\u00cb).<\/p>\n

Edhe norma programatike nga ana e saj, mund t\u00eb jet\u00eb perceptive, pasi ajo i drejtohet organeve shtet\u00ebrore p\u00ebr zbatim, duke i p\u00ebrcaktuar q\u00ebndrimet q\u00eb duhen mbajtur m\u00eb pas. Dhe kjo gj\u00eb b\u00ebhet me daljen e akteve ligjore dhe n\u00ebnligjore p\u00ebrkat\u00ebse p\u00ebr zbatimin e saj.
\nNga kjo analiz\u00eb modeste dhe e shkurt\u00ebr juridike dhe gjuh\u00ebsore, rrjedh se norma ligjore m\u00eb lart, tregon nj\u00eb vazhdim\u00ebsi (t\u00eb \u201ccunguar\u201d!), por jo nj\u00eb ndryshim apo transformim – formal, apo thelb\u00ebsor – t\u00eb identitetit t\u00eb kombit shqiptar.<\/p>\n

Jo v\u00ebt\u00ebm se nga ky moment e tutje, ATA (shqiptar\u00ebt XH. Z.) do t\u00eb em\u00ebrtohen si shqiptar\u00eb n\u00eb dokumentet e tyre zyrtare, por edhe para k\u00ebtij momenti, po ATA ishin shqiptar\u00eb. Dhe do jen\u00eb n\u00eb vazhdim.<\/p>\n

Vet\u00ebm n\u00ebse norma n\u00eb fjal\u00eb do shkruhej \u201cB\u00cbHEN shtetas shqiptar\u00eb t\u00eb gjith\u00eb ata q\u00eb kan\u00eb lindur ose q\u00eb jan\u00eb vendosur n\u00eb Shqip\u00ebri p\u00ebrpara 28 n\u00ebntorit t\u00eb 1912-s dhe q\u00eb, n\u00ebn qeverin\u00eb osmane kan\u00eb pasur KOMB\u00cbSIN\u00cb osmane\u201d, at\u00ebher\u00eb diskutimi do ishte i nj\u00eb natyre tjet\u00ebr. Q\u00eb p\u00ebr momentin nuk po e shtjelloj k\u00ebtu. Pasi duhet edhe shum\u00eb koh\u00eb (…).<\/p>\n
