Kushtetuta e Shqip\u00ebris\u00eb n\u00eb nenin 1, par. 2 thekson se \u201cRepublika e Shqip\u00ebris\u00eb \u00ebsht\u00eb shtet unitar dhe i pandash\u00ebm<\/em>\u201d.
\nTermi UNIK, gjendet edhe n\u00eb kushtetutat e shteteve t\u00eb tjera sovrane. Dhe jo pa q\u00ebllim.<\/p>\n

\u00c7far\u00eb do thot\u00eb termi UNIK?<\/strong>
\nN\u00eb radh\u00eb t\u00eb par\u00eb, do thot\u00eb q\u00eb askush nuk mund ushqej\u00eb ndjenja separatiste, p\u00ebr formimin e nj\u00eb \u201cenklave\u201d apo \u201crepublike\u201d brenda territorit t\u00eb nj\u00eb shteti sovran dhe unik.<\/p>\n

N\u00eb radh\u00eb t\u00eb dyt\u00eb, do thot\u00eb q\u00eb asnj\u00eb pjes\u00eb e territorit t\u00eb nj\u00eb shteti sovran dhe unik, nuk mund t\u2019i jepet nj\u00eb shteti fqinj. As edhe n\u00eb rast k\u00ebmbimi territoresh. B\u00ebhet fjal\u00eb jo vet\u00ebm p\u00ebr territorin tok\u00ebsor, por edhe p\u00ebr territorin ujor. N\u00eb Shtetin unik, sovraniteti ushtrohet nga i vetmi subjekt, q\u00eb \u00ebsht\u00eb vet\u00eb shteti, t\u00eb cilit i p\u00ebrket n\u00eb m\u00ebnyr\u00eb ekskluzive ushtrimi i funksioneve legjislative, juridike dhe administrative.<\/p>\n

Uniciteti dhe pandashm\u00ebria e nj\u00eb Shteti, jan\u00eb dy koncepte t\u00eb ndryshme n\u00eb pamje t\u00eb jashtme, por q\u00eb kualifikojn\u00eb nj\u00eb Shtet n\u00eb t\u00ebr\u00ebsin\u00eb e tij.
\nUniciteti, \u00ebsht\u00eb nj\u00eb integrim (edhe normativ) mes niveleve te ndryshme t\u00eb qeverisjes n\u00eb planin e brendsh\u00ebm. Por, edhe n\u00eb planin e jasht\u00ebm, uniciteti \u00ebsht\u00eb nj\u00eb konfirmim i integrimit t\u00eb territorit.<\/p>\n

Kurse pandashm\u00ebria, \u00ebsht\u00eb kufiri absolut i ndarjes s\u00eb territorit, ose i dor\u00ebzimit t\u00eb nj\u00eb pjese t\u00eb territorit tok\u00ebsor dhe ujor nj\u00eb shteti tjet\u00ebr fqinj. Uniciteti dhe pandashm\u00ebria e territorit t\u00eb nj\u00eb shteti sovran, kuptohen si kufinj t\u00eb pakap\u00ebrcyesh\u00ebm t\u00eb ekzistenc\u00ebs s\u00eb vet\u00eb k\u00ebtij Shteti.<\/p>\n

Neni 3 i Kushtetut\u00ebs, vijon se \u201cPavar\u00ebsia e shtetit dhe t\u00ebr\u00ebsia e territorit t\u00eb tij (\u2026\u2026) jan\u00eb baza e k\u00ebtij shteti, i cili ka p\u00ebr detyr\u00eb t\u2019i respektoj\u00eb dhe t’i mbroj\u00eb\u201d.<\/p>\n

Termi \u201cpavar\u00ebsi\u201d, i referohet asaj situate ku nj\u00eb shtet i lir\u00eb nuk i n\u00ebnshtrohet autoritetit t\u00eb asnj\u00eb Shteti tjet\u00ebr.<\/p>\n

Kurse termi \u201ct\u00ebr\u00ebsi e territorit\u201d, rrjedh direkt nga karakteri ekskluziv i sovranitetit territorial dhe \u00ebsht\u00eb nj\u00eb parim themelor i rendit juridik nd\u00ebrkomb\u00ebtar, q\u00eb cil\u00ebsohet edhe n\u00eb nenin 2, par. 4 t\u00eb Kart\u00ebs s\u00eb Kombeve t\u00eb Bashkuara (dhe nga karta t\u00eb tjera nd\u00ebrkomb\u00ebtare), i cili thekson se \u201cVendet an\u00ebtare duhet t\u00eb heqin dor\u00eb n\u00eb marr\u00ebdh\u00ebniet e tyre nd\u00ebrkomb\u00ebtare nga k\u00ebrc\u00ebnimi apo p\u00ebrdorimi i forc\u00ebs, si kund\u00ebr integritetit territorial ose pavar\u00ebsis\u00eb politike t\u00eb \u00e7do Shteti, si edhe n\u00eb \u00e7do form\u00eb tjet\u00ebr n\u00eb kund\u00ebrshtim me q\u00ebllimet e Kombeve t\u00eb Bashkuara\u201d.<\/p>\n

\"\"Koh\u00ebt e fundit, po diskutohet n\u00eb opinionin publik n\u00eb Shqip\u00ebri rreth problemit serioz dhe delikat q\u00eb po shkakton rishikimi i paktit detar mes Greqis\u00eb dhe Shqip\u00ebris\u00eb t\u00eb vitit 2009, i cili u hodh posht\u00eb nga Gjykata Kushtetuese me vendimin Nr.15 t\u00eb dat\u00ebs 15.04.2010. P\u00ebrs\u00ebri ky pakt po rishikohet tani nga Qeveria Socialiste Rama. Edhe pse ritrajtimi i paktit detar, duket ndryshe nga i m\u00ebparshmi nga ana formale, nga ana thelb\u00ebsore ai pakt mbetet i nj\u00ebjt\u00eb me paktin e m\u00ebparsh\u00ebm detar t\u00eb vitit 2009: dor\u00ebzimin Greqis\u00eb i nj\u00eb pjese t\u00eb territorit detar t\u00eb Shqip\u00ebris\u00eb. Kurse Greqia n\u00eb k\u00ebmbim, do jap\u00eb OK-n\u00eb e saj p\u00ebr hapjen e negociatave p\u00ebr hyrjen e Shqip\u00ebris\u00eb n\u00eb BE.<\/p>\n

Ndryshe, Shqip\u00ebria rrezikon shum\u00eb q\u00eb t\u00eb mos hyj\u00eb n\u00eb BE! (Personalisht, kam qen\u00eb, jam dhe do jem edhe n\u00eb t\u00eb ardhmen KUND\u00cbR hyrjes s\u00eb Shqip\u00ebris\u00eb n\u00eb BE. Por, ky opinion i imi nuk \u00ebsht\u00eb argumenti i k\u00ebtij shkrimi). Duke e trajtuar edhe nga ana penale k\u00ebt\u00eb problem, Kodi Penal n\u00eb Kreun V me titull \u201cKrime kund\u00ebr pavar\u00ebsis\u00eb dhe rendit kushtetues\u201d, n\u00eb seksionin i me titull \u201cKrime kund\u00ebr pavar\u00ebsis\u00eb dhe integritetit\u201d, tek neni 208 me titull \u201cDor\u00ebzimi i territorit\u201d, thekson se \u201cDor\u00ebzimi plot\u00ebsisht apo pjes\u00ebrisht i territorit nj\u00eb shteti apo fuqie t\u00eb huaj, me q\u00ebllim p\u00ebr t\u00eb c\u00ebnuar pavar\u00ebsin\u00eb dhe integritetin e vendit, d\u00ebnohet me burgim jo m\u00eb pak se pes\u00ebmb\u00ebdhjet\u00eb vjet ose me burgim t\u00eb p\u00ebrjetsh\u00ebm\u201d.<\/p>\n

Norma m\u00eb lart, \u00ebsht\u00eb shum\u00eb e qart\u00eb, pasi duke i \u201cdor\u00ebzuar pjes\u00ebrisht territor\u201d (tok\u00ebsor apo detar) \u201cnj\u00eb fuqie t\u00eb huaj\u201d, sjell q\u00eb \u201ct\u00eb c\u00ebnohet\u201d jo vet\u00ebm \u201cpavar\u00ebsia e vendit\u201d, por edhe \u201cintegriteti\u201d i tij. D\u00ebnimi \u00ebsht\u00eb mjaft serioz dhe i r\u00ebnd\u00eb: nga 15 vite burg deri n\u00eb burgim t\u00eb p\u00ebrjetsh\u00ebm. Edhe nenet 217 dhe 218, i referohen \u201cmarrjes s\u00eb shp\u00ebrblimeve\u201d dhe \u201cv\u00ebnies n\u00eb sh\u00ebrbim t\u00eb shteteve t\u00eb huaja\u201d, me \u201cq\u00ebllim kryerjen e veprave kund\u00ebr pavar\u00ebsis\u00eb dhe integritetit t\u00eb Republik\u00ebs s\u00eb Shqip\u00ebris\u00eb\u201d dhe d\u00ebnimet p\u00ebrkat\u00ebse\u201d!<\/p>\n

Pandashm\u00ebria territoriale, tregon se ajo nuk mund t\u00eb realizohet kurr\u00eb, pasi n\u00eb t\u00eb kund\u00ebrt ajo do i binte ndesh form\u00ebs institucionale t\u00eb \u00e7do Shteti, t\u00eb sanksionuar edhe me Kushtetut\u00eb. N\u00ebse i jepet nj\u00eb shteti fqinj qoft\u00eb edhe 1 cm tok\u00eb ose det, at\u00ebher\u00eb c\u00ebnohet parimi kushtetues i unicitetit dhe i t\u00ebr\u00ebsis\u00eb territoriale t\u00eb \u00e7do shteti sovran. Q\u00eb t\u00eb b\u00ebhen tratativa t\u00eb k\u00ebsaj r\u00ebnd\u00ebsie JETIKE p\u00ebr nj\u00eb komb, duhet t\u00eb ekzistoj\u00eb m\u00eb par\u00eb nj\u00eb baz\u00eb kushtetuese dhe ligjore p\u00ebr ta mb\u00ebshtetur dhe justifikuar at\u00eb. M\u00eb sakt\u00eb, duhet ndryshuar Kushtetuta dhe Kodi Penal! Pastaj, mund t\u00eb hyjn\u00eb n\u00eb diskutim aspektet e tera teknike.<\/p>\n

Qeveria Socialiste Rama, po p\u00ebrdor pik\u00ebrisht vendimin e Gjykat\u00ebs Kushtetuese t\u00eb vitit 2010, p\u00ebr t\u00eb trajtuar paktin detar nga ana formale, duke k\u00ebrkuar edhe plotfuqishm\u00ebrin\u00eb e Presidentit. Supozohet q\u00eb kjo plotfuqishm\u00ebri do merret nga Presidenti! E zgjidh problemin plotfuqishm\u00ebria e Presidentit? Por, duhet kap\u00ebrcyer edhe nj\u00eb penges\u00eb akoma m\u00eb e madhe, e cila \u00ebsht\u00eb Kushtetuta e Shqip\u00ebris\u00eb, q\u00eb e thekson shum\u00eb qart\u00eb \u201cUNICITETIN dhe PANDASHM\u00cbRIN\u00cb\u201d e Shqip\u00ebris\u00eb. K\u00ebsaj norme kushtetuese nuk mund t\u2019i dal\u00eb KURR\u00cb KUND\u00cbR jo vet\u00ebm Gjykata Kushtetuese e Shqip\u00ebris\u00eb, por as edhe \u00e7do gjykat\u00eb nd\u00ebrkomb\u00ebtare.<\/p>\n
