Duke e p\u00ebrcjellur n\u00eb k\u00ebt\u00eb vit kthes\u00ebn e madhe destruktive t\u00eb politik\u00ebs n\u00eb Kosov\u00eb, n\u00eb krah t\u00eb armiqve tan\u00eb shekullor\u00eb, nj\u00ebrin nd\u00ebr ta t\u00eb serb\u00ebve, dhe t\u00eb indinjuar nga instancat e \u201czgjedhura\u201d jo legjitime dhe jo me votat e shumic\u00ebs s\u00eb popullit t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, ne i llogarisim t\u00eb gjitha etnit\u00eb e k\u00ebsaj hap\u00ebsire, jo vet\u00ebm kombin shqiptar\u00eb, i cili \u00ebsht\u00eb 80 % i k\u00ebtij populli.<\/p>\n
Nuk kemi tjet\u00ebr mund\u00ebsi pos q\u00eb t`i b\u00ebjm\u00eb t\u00eb njohura q\u00ebndrimet tona t\u00eb akumuluara prej politik\u00ebs s\u00eb sotme destruktve dhe aktuale n\u00eb Kosov\u00eb dhe t`ua b\u00ebjm\u00eb t\u00eb ditura se Shteti i Kosov\u00ebs \u00ebsht\u00eb shtet i pavarur, i lir\u00eb e demokratik, me k\u00ebta kufij q\u00eb i ka trash\u00ebguar:<\/p>\n
1. Nga Kushtetuta e vitit 1974, si element konstituiv federativ;
\n2. Nga Kushtetuta e Kosov\u00ebs, e 7.9.1990, e amendamuar konform Referendumit t\u00eb 26-30 shtatorit 1991 p\u00ebr “shtetin sovran e t\u00eb pavarur t\u00eb Kosov\u00ebs”; n\u00eb t\u00eb cilin Referendumi p\u00ebr shqiptar\u00ebt e Kosov\u00ebs prej 77.8% votoi “p\u00ebr” (po) 99.8%, n\u00eb kufijt\u00eb q\u00eb kishte Kosova me Kushtetut\u00ebn e vitit 1974.<\/p>\n
3. Vendimet e Badinterit mbi Paktin e Varshav\u00ebs;
\n4. Gjykata Nd\u00ebrkomb\u00ebtare e Strasburg-ut dhe vendimet e saj;
\n5. Pakoja e Ahtisarit mbi Kosov\u00ebn;
\n6. Akti i Shpalljes s\u00eb Pavar\u00ebsis\u00eb s\u00eb Kosov\u00ebs, n\u00eb vitin 2008;<\/p>\n
7. Neni 1, pika 3, e Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs e ka p\u00ebrcaktuar se ajo nuk ka pretendime territoriale ndaj asnj\u00eb shteti tjet\u00ebr ose pjese t\u00eb ndonj\u00eb shteti tjet\u00ebr. Neni 2, pika 2 e Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs e p\u00ebrkufizon se “sovraniteti dhe integriteti territorial i Republik\u00ebs s\u00eb Kosov\u00ebs \u00ebsht\u00eb i pacenuesh\u00ebm, i patjet\u00ebrsuesh\u00ebm dhe i pandash\u00ebm. Ai mbrohet me t\u00eb gjitha mjetet e p\u00ebrcaktuara me k\u00ebt\u00eb Kushtetut\u00eb dhe Ligj”.<\/p>\n
8. N\u00eb fund, pranimi i Komisionit Nd\u00ebrkomb\u00ebtar si shtetit i pavarur, i lir\u00eb dhe sovran\u2026
\nQ\u00eb nga lasht\u00ebsia e k\u00ebtej, shihet e dokumentohet Kosova vet\u00ebm si mbijetes\u00eb kryesisht shqiptare.<\/p>\n
Ajo me aktet e saja komb\u00ebtare e nd\u00ebrkomb\u00ebtare nxirret si nj\u00eb vat\u00ebr e vazhdim\u00ebsis\u00eb s\u00eb qytet\u00ebrimit t\u00eb lasht\u00eb iliro-dardan dhe e zhvillimit t\u00eb kultur\u00ebs s\u00eb saj, n\u00eb radh\u00eb t\u00eb par\u00eb t\u00eb zhvillimit t\u00eb gjuh\u00ebs shqipe n\u00ebp\u00ebrmes t\u00eb iliro-dardan\u00ebve dhe gjuh\u00ebve t\u00eb tjera t\u00eb pakicave komb\u00ebtare.<\/p>\n N\u00eb baz\u00eb t\u00eb k\u00ebtyre akteve juridiko-kushtetuese dhe nd\u00ebrkomb\u00ebtare Kosova \u00ebsht\u00eb e njohur me kufijt\u00eb ekzistues dhe vet\u00eb pranimi i saj si shtet i pavarur dhe sovran \u00ebsht\u00eb n\u00eb t\u00ebr\u00ebsin\u00eb e sotme territoriale t\u00eb saj.<\/p>\n N\u00eb saje t\u00eb globalizimit si ideologji dhe strategji nd\u00ebrkomb\u00ebtare \u00ebsht\u00eb ngritur statusi i autonomis\u00eb n\u00eb statusin e pavar\u00ebsis\u00eb, e cila ishte prej Luft\u00ebs s\u00eb II-t\u00eb bot\u00ebrore p\u00ebr t`u b\u00ebr\u00eb.<\/p>\n \u00c7do cenim territorial i sovranitetit t\u00eb Kosov\u00ebs bie ndesh me rrug\u00ebn e saj historike e n\u00eb kund\u00ebrshtim nd\u00ebrkomb\u00ebtar t\u00eb theksuar m\u00eb lart\u00eb. Kjo bie ndesh edhe me vullnetin e p\u00ebrgjithsh\u00ebm tonin disavje\u00e7ar p\u00ebr pavar\u00ebsin\u00eb e Kosov\u00ebs.<\/p>\n \u00cbsht\u00eb populli i Kosov\u00ebs ai q\u00eb \u00ebsht\u00eb i pal\u00ebvizsh\u00ebm. Shteti Kosov\u00ebs \u00ebsht\u00eb mbi individin, e individi nuk ka imunitet dhe t\u00eb drejt\u00eb t\u00eb cenoj\u00eb t\u00eb drejt\u00ebn e sovranit mbi t\u00eb drejt\u00ebn e interesit t\u00eb p\u00ebrgjithsh\u00ebm shoq\u00ebror t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs; t\u00eb drejt\u00ebn e pron\u00ebs, pra t\u00eb tok\u00ebs, q\u00eb \u00ebsht\u00eb e shenjt\u00eb dhe e garantuar me konventa nd\u00ebrkomb\u00ebtare.<\/p>\n Individ\u00ebt, q\u00eb pavar\u00ebsisht se gjenden n\u00eb \u201cinstitucionet\u201d e caktuara shtet\u00ebrore, edhe n\u00ebse kan\u00eb aft\u00ebsi t\u00eb kufizuara profesionale, kishte me qen\u00eb e rrug\u00ebs q\u00eb t\u00eb k\u00ebrkojn\u00eb zgjidhje nga institucionet shtet\u00ebrore e profesionale p\u00ebr zgjidhjen e problemeve t\u00eb caktuara, t\u00eb cilat jan\u00eb n\u00eb interesin e p\u00ebrgjithsh\u00ebm shoq\u00ebror t\u00eb shtetit t\u00eb Kosov\u00ebs, duke mos e cenuar t\u00eb drejt\u00ebn e sovranit dhe t\u00ebr\u00ebsis\u00eb territoriale t\u00eb Kosov\u00ebs, e cila \u00ebsht\u00eb pron\u00eb e shenjt\u00eb e sovranitetit.<\/p>\n Sovrani i shtetit t\u00eb Kosov\u00ebs \u00ebsht\u00eb populli i Kosov\u00ebs, t\u00eb gjith\u00eb qytetar\u00ebt e Kosov\u00ebs, pa dallim t\u00eb etnis\u00eb, besimit, gjinis\u00eb e kultur\u00ebs. Kosova \u00ebsht\u00eb shtet juridiko-kushtetues parlamentar, e jo presidencial apo centralist. \u00c7\u00ebshtja e l\u00ebvizjes s\u00eb kufirit \u00ebsht\u00eb jasht\u00eb kushtetuese. \u00c7do lloj \u201cmarr\u00ebveshje\u201d me Serbin\u00eb, t\u00eb ndikuar nga politika e Rusis\u00eb, qoft\u00eb edhe me nj\u00eb p\u00ebrkrahje t\u00eb individ\u00ebve nd\u00ebrkomb\u00ebtar \u00ebsht\u00eb jo ligjore dhe jo demokratike. Ajo \u00ebsht\u00eb nj\u00eb humbje e madhe p\u00ebr ne, \u00ebsht\u00eb humbje materiale, \u00ebsht\u00eb nj\u00eb \u00e7\u00ebshtje t\u00ebr\u00ebsisht e d\u00ebmshme, me pasoja t\u00eb rrezikshme p\u00ebr t\u00ebr\u00eb bot\u00ebn per\u00ebndimore.<\/p>\n Dialogu me Republik\u00ebn e Serbis\u00eb n\u00eb drejtim t\u00eb shtetit dhe cenimit t\u00eb kufijve t\u00eb Kosov\u00ebs nuk do t\u00eb mund t\u00eb fillohet e t\u00eb kryhet pas tet\u00ebmb\u00ebdhjet\u00eb (18) viteve p\u00ebrpjekje p\u00ebr realizim t\u00eb sovranitetit e pavar\u00ebsis\u00eb s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs, aq m\u00eb pak \u201ci prir\u00eb\u201d prej nj\u00eb individi jo legjitim. Legjitimiteti nuk vije prej popullit t\u00eb Kosov\u00ebs, p\u00ebr t\u00eb cil\u00ebn kan\u00eb marr\u00eb pjes\u00eb n\u00eb zgjedhje vet\u00ebm 45% t\u00eb popullit t\u00eb Kosov\u00ebs, pra m\u00eb pak se gjysma. E p\u00ebr t\u00eb qen\u00eb k\u00ebshtu legjitim duhet t\u00eb marrin pjes\u00eb mbi 51% e zgjedh\u00ebsve. Kjo qeveri duhet t\u00eb kthehej n\u00eb rizgjedhje dhe t\u00eb pranoj\u00eb humbjen e saj. Rreth 55% e popullit nuk doli n\u00eb rizgjedhje.<\/p>\n Nd\u00ebrkaq, Serbia paraprakisht duhet q\u00eb ta pranoj\u00eb Republik\u00ebn e Kosov\u00ebs: \u00c7far\u00ebdo Marr\u00ebveshje eventuale e Presidentit t\u00eb Kosov\u00ebs, me 11 n\u00ebntor 2018, apo kurdoher\u00eb tjet\u00ebr, e cila e cenon sovranitetin dhe integritetin territorial t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs nuk do t\u00eb pranohet nga shqiptar\u00ebt; do t\u00eb shpallet si akt tradhtie ndaj popullit shqiptar, qytetar\u00ebve e shtetasve t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs dhe do t\u00eb mbrohet sovraniteti e integriteti territorial i Republik\u00ebs s\u00eb Kosov\u00ebs, me t\u00eb gjitha mjetet e p\u00ebrcaktuara me Kushtetut\u00eb dhe Ligj (Neni 2, pika 2, i Kushtetut\u00ebs s\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs). Presidenti nuk mund t\u00eb n\u00ebnshkruaj\u00eb protokoll bisedimi Kosov\u00eb e Serbi, sepse hedhja e n\u00ebnshkrimit t\u00eb Presidentit t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs \u00ebsht\u00eb kund\u00ebr pavar\u00ebsis\u00eb territoriale dhe t\u00eb sovranitetit t\u00eb saj.<\/p>\n Ne jemi t\u00eb mendimit se tri qytetet e Kosov\u00ebs Lindore n\u00eb Serbi duhet t\u00eb b\u00ebjn\u00eb autonomin\u00eb e vet, t\u00eb shpallur me referendum, me t\u00eb drejt\u00ebn e vet\u00ebvendosjes, sipas konventave nd\u00ebrkomb\u00ebtare. Rezoluta nr. 637 (VII), e Asambles\u00eb s\u00eb P\u00ebrgjithshme t\u00eb OKB, e miratuar m\u00eb 16.12.1952 thekson se: \u201cE drejta e vet\u00ebvendosjes s\u00eb popujve dhe kombeve \u00ebsht\u00eb parakusht p\u00ebr respektimin e plot\u00eb t\u00eb t\u00eb drejtave dhe lirive t\u00eb njeriut\u201d. Nj\u00ebkoh\u00ebsisht, Rezoluta nr. 1514 (XV), e s\u00eb nj\u00ebjt\u00ebs instanc\u00eb nd\u00ebrkomb\u00ebtare, e dat\u00ebs 14.12.1960, Neni 1, p\u00ebrcakton se \u201cIntegrimi i nj\u00eb territori etnik duhet t\u00eb jet\u00eb rezultat i shprehjes s\u00eb vullnetit t\u00eb lir\u00eb t\u00eb popujve t\u00eb atij territori\u201d.<\/p>\n N\u00eb baz\u00eb t\u00eb Nenit 2, t\u00eb s\u00eb nj\u00ebjtes Rezolut\u00eb tektualisht thuhet se \u201cT\u00eb gjith\u00eb popujt kan\u00eb t\u00eb drejt\u00ebn e vet\u00ebvendosjes p\u00ebrmes t\u00eb cilit mund t\u00eb p\u00ebrcaktojn\u00eb lirisht statusin e tyre politik, p\u00ebr t\u00eb vazhduar zhvillimin e tyre ekonomik, kulturor dhe shoq\u00ebror\u201d. K\u00ebshtu i kemi disa rezoluta t\u00eb OKB-s\u00eb q\u00eb e fiksojn\u00eb t\u00eb drejt\u00ebn e vetvendosjes dhe t\u00eb drejtat e tjera, t\u00eb cilat Republika e Serbis\u00eb nuk i ka respektuar aspak p\u00ebr Sanxhakun, Preshev\u00ebn, Bujanocin e Medvegjen, sikurse edhe p\u00ebr Vojvodin\u00ebn.<\/p>\n Nuk \u00ebsht\u00eb absolutisht e drejt\u00eb dhe e arsyeshme t\u00eb k\u00ebmbehen tokat shqiptare t\u00eb Kosov\u00ebs Veriore, me plot minerale e pasuri t\u00eb tjera, me nj\u00eb pjes\u00eb t\u00eb tokave tjera shqiptare n\u00ebn Serbi, t\u00eb cilat jan\u00eb t\u00eb kolonizuara dhe t\u00eb diskriminuara deri n\u00eb fund nga Serbia. Ne, edhe nj\u00ebher\u00eb e ngritim z\u00ebrin p\u00ebrpara JUSH kund\u00ebr k\u00ebsaj padrejt\u00ebsie.<\/p>\n Faza finale e k\u00ebtij \u201cprocesi\u201d ka p\u00ebrfunduar n\u00eb vitin 2008 kur \u00ebsht\u00eb shpallur pavar\u00ebsia, dhe askush nuk ka t\u00eb drejt\u00eb t\u00eb zhb\u00ebj\u00eb k\u00ebt\u00eb pavar\u00ebsi, as t\u00eb kontaktoj\u00eb personalitetet e dyshimta t\u00eb Mosk\u00ebs e Serbis\u00eb. Subjektet politike nuk guxojn\u00eb t\u00eb k\u00ebrkojn\u00eb e as t\u00eb nxjerrin as \u201crezoluta\u201d t\u00eb p\u00ebrkrahjes s\u00eb kompromisit.<\/p>\n E drejta e sovranit \u00ebsht\u00eb e drejt\u00eb e pamohueshme dhe demokratike, e cila, mund\u00eb t\u00eb shprehet edhe p\u00ebrmes referendumit. P\u00ebr \u00e7do p\u00ebll\u00ebmb\u00eb t\u00eb tok\u00ebs s\u00eb tij vendos populli i tij, me vullnetin e tij, dhe jo individ\u00ebt. Populli \u00ebsht\u00eb ai q\u00eb nuk ia njeh dhe nuk i pranon aktet e veprimet individuale dhe centraliste, t\u00eb cilat bien n\u00eb kund\u00ebrshtim me interesat e p\u00ebrgjithshme t\u00eb popullit sovran t\u00eb Shtetit t\u00eb Kosov\u00ebs, me kufijt\u00eb q\u00eb ka sot.<\/p>\n \u201cReferendumi n\u00eb Parlament\u201d, \u00ebsht\u00eb mjegulla e dyt\u00eb q\u00eb ia hedhin para duarve n\u00eb Kuvend, e jo para popullit demokratik. Referendumi \u00ebsht\u00eb baz\u00eb e zgjidhjeve tuaja, kur nuk zgjidhet nga t\u00eb nj\u00ebjtat instanca. Fraksioni ndahet nga e nj\u00ebjta parti dhe e nxjerr\u00eb n\u00eb popull, krijohet trupa e ve\u00e7ant\u00eb p\u00ebr referendumin.<\/p>\n Referendumi nuk guxon t\u00eb ket\u00eb forma centraliste dhe t\u00eb jet\u00eb me dyshim t\u00eb bazuar centraliste nga individ t\u00eb caktuar, por duhet t\u00eb jet\u00eb me burim nga baza e nga populli, me shprehje t\u00eb arsyeshme demokratike, e cila nuk i cenon n\u00eb asnj\u00eb m\u00ebnyr\u00eb, e as t\u00eb shkelur me korrupsion, interesin e p\u00ebrgjithsh\u00ebm shoq\u00ebror\u00eb, t\u00eb t\u00ebr\u00ebsis\u00eb territoriale t\u00eb Kosov\u00ebs dhe sovranitetin e tij si shtet i pavarur dhe demokratik, i njohur nga shtetet demokratike dhe i pranuar nga organizatat e Gjykata Nd\u00ebrkomb\u00ebtare.<\/p>\n Ne, intelektual\u00ebt shqiptar\u00eb t\u00eb Kosov\u00ebs, qytetar\u00ebt e lir\u00eb e t\u00eb pavarur, shprehim pak\u00ebnaq\u00ebsin\u00eb ton\u00eb t\u00eb madhe lidhur me cenimin dhe shkeljen e t\u00eb drejtave tona t\u00eb shenjta, si\u00e7 jan\u00eb jeta, prona, puna, pasuria n\u00ebntok\u00ebsore e mbitok\u00ebsore, kufiri, sovraniteti e shteti. Imponimi \u00ebsht\u00eb n\u00eb kund\u00ebrshtim me Konventat demokratike dhe t\u00eb interesit t\u00eb sovranit, pra popullit dhe riokupim i nj\u00eb shteti t\u00eb sapo formuar. T\u00eb gjitha k\u00ebto mund t\u00eb nxirren pas kalimit t\u00eb faz\u00ebs kalimtare, t\u00eb kufizuara nga bashk\u00ebsia nd\u00ebrkomb\u00ebtare, p\u00ebr t\u00eb cilat neve po u lusim n\u00eb lidhje t\u00eb t\u00eb gjitha p\u00ebrcaktimeve t\u00eb lira e demokratike q\u00eb i keni, p\u00ebr t`i kufizuar mir\u00eb, me kusht q\u00eb \u00e7do vendim q\u00eb merret gjat\u00eb k\u00ebsaj faze nuk bie ndesh me aktet dhe konventat nd\u00ebrkomb\u00ebtare, t\u00eb cilat do t\u00eb nxisnin po k\u00ebshtu konflikte t\u00eb reja n\u00eb shtetet e reja dhe t\u00eb treta, e t\u00eb cilat kan\u00eb vet\u00ebm pasoja me p\u00ebrmasa t\u00eb m\u00ebdha, shkat\u00ebrruese dhe t\u00eb pa p\u00ebrmir\u00ebsueshme, sepse t\u00eb gjitha shtetet, edhe ato t\u00eb tretat, jan\u00eb t\u00eb krijuara e t\u00eb b\u00ebra nga nacionalitete t\u00eb ndryshme dhe shum\u00eb etnike, e jo shtetet nj\u00eb etnike, si\u00e7 pretendon politika nacionaliste e Serbis\u00eb.<\/p>\n T\u00eb dy Luft\u00ebrat Bot\u00ebrore (I e II) kan\u00eb qen\u00eb t\u00eb shkaktuara nga Serbia. Luft\u00ebn e III-t\u00eb do ta sjellte pik\u00ebrisht ajo, edhe me sh\u00ebrb\u00ebtor\u00ebt e politik\u00ebs s\u00eb Serbis\u00eb e Rusis\u00eb, n\u00eb Kosov\u00eb. Aq m\u00eb tep\u00ebr, nacionaliteti \u201cserb\u201d nuk ekziston. Ajo \u00ebsht\u00eb e caktuar vet\u00ebm n\u00eb baza centraliste fetare ortodokse…<\/p>\n E lusim bot\u00ebn e gjall\u00eb per\u00ebndimore e demokratike t\u00eb na ndihmoj\u00eb, n\u00eb saje t\u00eb demokracis\u00eb s\u00eb mir\u00ebfillt\u00eb, n\u00eb saje t\u00eb s\u00eb drejt\u00ebs s\u00eb lir\u00eb t\u00eb shprehjes e t\u00eb marrjes s\u00eb mendimit demokratik p\u00ebrfundimtar, n\u00eb raport me \u00e7\u00ebshtjet nd\u00ebrkomb\u00ebtare , me \u00e7\u00ebshtjet politike, me \u00e7\u00ebshtjet e shteteve.<\/p>\n Ne, q\u00ebllimisht jemi t\u00eb shkelur nga t\u00eb tjer\u00ebt dhe t\u00eb ndar\u00eb n\u00eb disa pjes\u00eb t\u00eb ish Jugosllavis\u00eb, gjegj\u00ebsisht n\u00ebn Serbi, Mal t\u00eb Zi dhe Maqedoni, por n\u00eb k\u00ebt\u00eb rast d\u00ebshirojm\u00eb t`i prezantojm\u00eb t\u00eb gjitha viset e Republik\u00ebs s\u00eb Kosov\u00ebs si t\u00ebr\u00ebsi e p\u00ebrbashk\u00ebt territoriale dhe e pa ndashme n\u00eb m\u00ebnyr\u00eb arbitrare!<\/p>\n Ne nuk jem parti, nuk b\u00ebjm\u00eb politik\u00eb parciale e minore, por jemi t\u00eb pavarur plot\u00ebsisht nga partit\u00eb dhe destruktiviteti i tyre antidemokratik.<\/p>\n Duke pasur shpres\u00eb p\u00ebr nd\u00ebrmarrjen tuaj konkrete n\u00eb nd\u00ebrprerjen e veprimeve t\u00eb individ\u00ebve t\u00eb caktuar dhe politik\u00ebn destruktive t\u00eb cil\u00ebn e b\u00ebjn\u00eb n\u00eb Kosov\u00eb, Serbi e t\u00eb Lindjes, jo demokratike, pik\u00ebrisht n\u00eb Rusi, presim me padurim nd\u00ebrmarrjen dhe p\u00ebrgjigjen tuaj.<\/p>\n Me respekt t\u00eb madh: Prishtin\u00eb, 7 n\u00ebntor 2018<\/em>.<\/p>\n Brahim Ibish AVDYLI ______________________<\/p>\n (Fahu Postal Nr. 5\/12 000 Fush\u00eb Kosov\u00eb\/ RKS ENGLISH<\/em><\/strong><\/p>\n To: Dear Ladies, All these can be drawn after the end of the transitional stage, limited by the international community, for what we plea in lieu of all the free and democratic definitions that you have, to limit them well, under the condition that any decision made during this stage does not contravene the international acts and conventions, which would also instigate new conflicts in new, third countries, which bear only tremendous consequences, destructive and irreparable because all the countries, the third ones too, are created and made by different and multiethnic nationalities, and not ethnic states, as the nationalistic politics of Serbia pretends.<\/p>\n Both the World Wars (I and II) have been caused by Serbia. \nDear Gentlemen,
\nThis year, we have been following the great destructive turn of the politics in Kosovo, side-by-side with our centuries old enemies, the Serbs as one of them, and indignant by illegitimate, \u201celected\u201d instances and not by the votes of the majority of people of the Republic of Kosovo, we count all the ethnicities of this area, not only the Albaian nation, which is the 80% of these people. We do not have other possibility but to make known our stands as accumulated by the today\u2019s destructive and current politics in Kosovo, and to make it known that the Country of Kosovo is an Independent State, free and democratic, with these borders it inherited:
\n1. By the Constitution of the year 1974 as a federal constituent;
\n2. By the Kosovo Constitution of September 7, 1990, amended in conformity with the referendum of September 26-30, 1991, on the \u201cindependent and sovereign state of Kosovo\u201d, in which, out of the 77.8% of Kosovo Albanians, 99.8% of them voted \u201cYes\u201d, in the borders Kosovo had by the Constitution of the year 1974.
\n3. Badinter Decisions on Warsaw Treaty;
\n4. International Court in Strasbourg and its decisions;
\n5. Ahtisaari package on Kosovo;
\n6. The Act of the Declaration of Kosovo\u2019s Independence in the year 2008;
\n7. Article 1, item 3 of the Constitution of the Republic of Kosovo has determined that it has no territorial claims towards any other country or part of any other country. Article 2, item 2 of the Constitution of the Republic of Kosovo defines that \u201cthe the sovereignty and territorial integrity of the Republic of Kosovo is inviolable, inalienable and undividable. It is protected by all the means specified by this Constitution and by Law\u201d.
\n8. Finally, the recognition by the International Commission as an Independent, Free and Sovereign Country\u2026
\nSince the ancient times and on, Kosovo is seen and documented only as a survival, mainly Albanian.
\nBy its national and by international acts, It (Kosovo) is inferred as a hearth of continuity of the Illyrian-Dardanian ancient civilization, and of development of its culture, firstly development of Albanian language through Illyrian-Dardanians and other languages of national minorities.
\nPursuant to these juridical-constitutional and international acts, Kosovo has been recognized with its current borders, and the recognition itself of Kosovo as an independent and sovereign state is at its today\u2019s territorial integrity
\nDue to the globalization as an ideology and international strategy the status of autonomy has been elevated to the status of independence, which was to be done since World War II.
\nAny territorial encroachment of Kosovo\u2019s sovereignty conflicts with its historic way and international opposition stressed above. This also conflicts our general, long-lasting will for the independence of Kosovo.
\nIt is the people of Kosovo who are immovable. The country of Kosovo is above the individual, while the individual has no immunity and right to infringe the right of the Sovereign on the right of general social interest of the Republic of Kosovo; the right on the property, hence the right on the land, that is holy and guaranteed by international conventions.
\nIndividuals, regardless of them being in certain, state \u201cinstitutions\u201d, even if they have limited professional abilities, would be appropriate to seek solutions from state and professional institutions for the solution of certain problems, which are at the general social interest of the state of Kosovo, while not infringing the right of the Sovereign on the territorial integrity of Kosovo, which is a holy property of the sovereignty.
\nThe Sovereign of the state of Kosovo are the people of Kosovo, all the citizens of Kosovo regardless of their ethnicity, belief, gender or culture.
\nThe people have the right to restore its sovereignty, respectively to revoke the right of representation at any time, when they estimate that the interests of their sovereignty and territorial integrity of the Republic of Kosovo have been betrayed. This right is also issued by the doctrine of the American ex-President Abraham Lincoln (1861 \u2013 1864), which should be a positive example and be respected by the entire democratic world.
\nKosovo is a juridical-constitutional, parliamentary state, and not a presidential or a centralist one. The matter of moving the border is unconstitutional. Any kind of \u201cagreement\u201d with Serbia, influenced by politics of Russia, even if it is supported by international individuals is illegal and non-democratic. It is a great loss for us, it is a material loss, and it is a totally harmful matter, with dangerous consequences for the entire western world.
\nDialogue with the Republic of Serbia towards the State and infringement of the borders of Kosovo cannot be started and finished after eighteen (18) years of struggle to realize the sovereignty and independence of the Republic of Kosovo, less \u201clead\u201d by an illegitimate individual. Legitimacy does not come from the people of Kosovo, for what only 45% of the people of Kosovo participated, hence less than half of it. While to be legitimate, more than 51% of electorate should participate. This government should have gone back to reelections and to admit its defeat. About 55% of the people did not go to revote. While Serbia should preliminarily recognize the Republic of Kosovo:
\n– As a sovereign and independent state with its currently existing borders;
\n– To pay for the war damages caused to the Albanian people, their property and socially-owned property;
\n– Te return the missing Albanians from Kosovo
\n– Te return the pensions and contributions of the workers who have worked until the imposed measures by Serbia;
\n– To apologize for the atrocities committed to Albanians,
\n– Then, perhaps, it would be possible to enter into negotiations through some special commission of both the countries by international mediation after having demilitarized the republic of Sanxhak, Presevo, Bujanovac and Medvedja; the recognition of the right to self-determination, exactly according to the international conventions on this matter.
\nAny eventual Agreement of the President of Kosovo on November 11, 2018 or whatever time after, which infringes the sovereignty and territorial integrity of the Republic of Kosovo shall not be accepted by the Albanians; it will be declared as an act of treason towards the Albanian people, citizens of the republic of Kosovo and the sovereignty and territorial integrity of the Republic of Kosovo shall be protected defined by the Constitution and Law (Article 2, item 2 of the Constitution of the Republic of Kosovo).
\nIt is our obligation to let YOU know, Dear Ladies and Gentlemen of the Democratic World, that you have the power to prevent this aggressive game of Serbia, Russia with our lands.
\nThe President cannot sign a protocol on talks Kosovo \u2013 Serbia because the placement of signature by the President of the Republic of Kosovo is against its territorial independence and its sovereignty, and it would only be a clearly developed anti-national treason.
\nOur opinion is that the three cities of the Eastern Kosovo in Serbia should make their autonomy, declared by a referendum, with the right of self-determination in accordance with international conventions. The resolution No.637 (VII) of the General Assembly of the United Nations, adopted on December 16, 1952 states that: \u201cThe right to self-determination of people and nations is a precondition for the full respect of the human rights and freedoms\u201d. At the same time, the resolution No.1514 (XV) of the same international instance, of December 14, 1960, Article 1 defines that \u201cThe integration of an ethnic territory should be a result of the expression of the free will of the people of that territory\u201d. Pursuant to Article 2 of the same Resolution, it is textually stated that \u201cAll the people have the right to self-determination through which they can freely determine their political status to continue with their economic, cultural and social development\u201d. Thus there are several resolutions of the UNO that fix the right to self-determination and other rights, which the republic of Serbia has not been respecting for Sanxhak, nor for Presevo, Bujanovac or Medvedja, nor for Vojvodina also.
\nIt is absolutely not right and reasonable to exchange Albanian lands of Northern Kosovo, full of minerals and other treasures, with a piece of other Albanian lands under Serbia, which have been colonized and discriminated up to the end by Serbia. Once more, we raise our voice in front of YOU against this injustice!
\nThe final stage of this \u201cprocess\u201d has ended in the year 2008 when the independence was declared, and nobody has the right to undo this independence, nor to contact suspicious personalities of Moscow and Serbia. Political subjects do not dare to seek or to issue \u201cresolutions\u201d in support of the compromise.
\nThe right of the Sovereign is an undeniable and democratic right, which can be expressed by a referendum. For each span of its land, its people shall decide, at their own will, and not individuals. The people are the ones that do not recognize and do not accept individual and centralist acts and actions that contravene the general interests of the sovereign people of the State of Kosovo with the borders it has today.
\n\u201cReferendum in Parliament\u201d is the second fog they are thrown in front their hands in Parliament, and not in front of the democratic people. Referendum is a basis of your solutions, when not solved by the same instances. The fraction is divided by the same party and if taken to the people, a special body is created for the referendum.
\nThe referendum should not have centralist shapes and to be in based centralist suspicion by certain individuals, but it should derive from the base and from the people, with reasonable democratic expression, which does not infringe in any way, nor violated with corruption, the general social interest, territorial integrity of Kosovo and its sovereignty as an independent and democratic state, recognized by the democratic countries and accepted by organizations and by International Court.
\nWe, Albanian intellectuals of Kosovo, free and independent citizens from all the regions of Kosovo express our great dissatisfaction regarding the infringement and violation of our holy rights like: lives, property, work, underground and above ground treasure, border, sovereignty and state.
\nWe ought to stress that heads of states meeting in Paris of France for this matter, firstly Serbia and Kosovo, should respect and recognize the rights of the territorial sovereignty and of state of each-other by international guarantee, and after recognizing each-other in a democratic manner, respecting the right of the Sovereign, and by the free expression of referendum on the certain matter, and which are not against general social interests of the Republic of Kosovo, then other parts of this talk shall be part our discussions, and not a concluded part of an imposed \u201cagreement\u201d. The imposition is against the democratic Conventions and the interest of the Sovereign, thus people, and is re-occupancy of a just established country!<\/p>\n
\nWe ask the vital, western and democratic world to help us by true democracy, by the right of free expression and final democratic decision making opinion in relation to the international matters, political matters, matters of states.<\/p>\n
