Ngjarjet e dit\u00ebve t\u00eb fundit n\u00eb lidhje me pengimin e p\u00ebrdorimin e flamurit komb\u00ebtar shqiptar t\u00eb p\u00ebrkujtojn\u00eb koh\u00ebt e kaluara, ku ndalohej simboli komb\u00ebtar n\u00eb saj\u00eb t\u00eb nj\u00eb albanofobie e cila po rikthet p\u00ebrseri q\u00eb \u00ebsht\u00eb kund\u00ebr barazis\u00eb qytetare dhe komb\u00ebtare t\u00eb shqiptar\u00ebve dhe mos respektimit praktik t\u00eb ligjeve q\u00eb jan\u00eb miratuar n\u00eb n\u00eb Mal t\u00eb Zi kur jan\u00eb n\u00eb pyetje popujt pakic\u00eb n\u00eb k\u00ebt\u00eb mjedis multinacional.<\/em><\/p><\/blockquote>\n

Edhe pse me Kushtetut\u00ebn e Malit t\u00eb Zi neni 79 pika 2 si dhe me Ligjin p\u00ebr p\u00ebrdorimin e simboleve komb\u00ebtare neni 1, 2 dhe 3, \u00ebsht\u00eb i lejuar p\u00ebrdorimi i simbolit komb\u00ebtar t\u00eb popujve pakic\u00eb n\u00eb Mal t\u00eb Zi, dit\u00ebve t\u00eb fundit n\u00eb praktik\u00eb \u00ebsht\u00eb paraqitur nj\u00eb albanofobi, pik\u00ebrisht nga ata q\u00eb duhet t\u00eb mbrojn\u00eb qytetar\u00ebt nga provokimet e ndryshme, kur jan\u00eb n\u00eb pyetje t\u00eb drejtat qytetare dhe nacionale.<\/p>\n

Dhe pik\u00ebrisht n\u00eb dit\u00ebn e fest\u00ebs komb\u00ebtare t\u00eb shqiptar\u00ebve me 28 n\u00ebntor n\u00eb Ulqin, n\u00eb vend q\u00eb festa e shqiptar\u00ebve t\u00eb nd\u00ebrohej duke vendosur flamuj komb\u00ebtar n\u00eb qytet sikurse vit\u00ebve t\u00eb m\u00ebparshme, ndodhi nj\u00eb incident i papritur me nj\u00eb qytetar, i cili \u00ebsht\u00eb ndaluar nga policia lokale me argumentin se n\u00eb makin\u00ebn e tij ka vendosur dy flamuj t\u00eb vegj\u00ebl komb\u00ebtar shqiptar. Arsyeja ishte se ai (S.V.) ka shpalosur flamurin e nj\u00eb shteti tjet\u00ebr, q\u00eb \u00ebsht\u00eb e ndaluar me ligj. Dhe personi n\u00eb fjal\u00eb \u00ebsht\u00eb procesuar dhe d\u00ebrguar te gjykat\u00ebsi p\u00ebr kund\u00ebrvajtje, ku pritet t’i jepet vendimi i denimit. Ishte ky rasti i par\u00eb deri m\u00eb tash ku ka vepruar policia, nga miratimi i ligjit p\u00ebr simbole komb\u00ebtare nga viti 2000.<\/p>\n

Nj\u00eb lajm i till\u00eb p\u00ebr opinionin ishte befasi e papritur dhe e papranueshme, por nuk vonoi shum\u00eb dhe di\u00e7ka e till\u00eb u njoftua nga Mal\u00ebsia (4.12.2018). Mediat njoftuan se n\u00eb fshatin Milesh, qytetari E.B. n\u00eb kulmin e sht\u00ebpis\u00eb n\u00eb nd\u00ebrtim ka vendosur flamurin komb\u00ebtar shqiptar. Edhe ai \u00ebsht\u00eb d\u00ebrguar n\u00eb polici, \u00ebsht\u00eb procesuar si dhe i \u00ebsht\u00eb marr\u00eb flamuri komb\u00ebtar si mjet delikti. Pritet vendimi i gjykat\u00ebsit p\u00ebr mas\u00ebn e d\u00ebnimit. Dhe nj\u00eb veprim i till\u00eb nga policia arsyetohet me Ligjin p\u00ebr qet\u00ebsi e rend publik, neni 23 (Sl. list CG, nr. 64\/11).<\/p>\n

Kemi t\u00eb b\u00ebjm\u00eb me nj\u00eb ligj, i cili nuk \u00ebsht\u00eb harmonizuar me Ligjin p\u00ebr p\u00ebrdorimin e simboleve komb\u00ebtare (Sl. list RCG, nr.\u00a0 55.\/00), q\u00eb paraqet dob\u00ebsin\u00eb profesionale t\u00eb hartuesve t\u00eb tij, si dhe mos reagimin nga Ministria e drejtave t\u00eb njeriut dhe t\u00eb pakicave. Nd\u00ebrsa duke pasur parasysh sindromin antishqiptar i trash\u00ebguar nga e kaluara nuk kemi si t\u00eb mos dyshojm\u00eb se nj\u00eb veprim i till\u00eb \u00ebsht\u00eb b\u00ebr\u00eb me q\u00ebllim, duke i dh\u00ebn\u00eb mund\u00ebsi urdh\u00ebrdh\u00ebn\u00ebsit q\u00eb policia t\u00eb veproj n\u00eb terren n\u00eb m\u00ebnyr\u00eb utilitare, sipas inercionit sikurse ishte rasti dit\u00eb m\u00eb par\u00eb n\u00eb Ulqin e Mal\u00ebsi.<\/p>\n

Nj\u00eb rast i till\u00eb t\u00eb kujton vitin 1992, kur n\u00eb Tuz, Rrok Dushaj n\u00eb promovimin e Lidhjes Liberale t\u00eb Mal t\u00eb Zi, ka p\u00ebrdorur flamurin shqiptar dhe \u00ebsht\u00eb d\u00ebnuar p\u00ebr kund\u00ebrvajtje, duke paguar gjob\u00ebn n\u00eb vler\u00eb prej 3000 dinar\u00eb.<\/p>\n

N\u00eb rastin konkret polic\u00ebt jan\u00eb m\u00eb s\u00eb paku fajtor\u00eb, por p\u00ebrgjegj\u00ebsia kyesore bie mbi urdh\u00ebrdh\u00ebn\u00ebsite tyre, t\u00eb cil\u00ebt n\u00eb rastin konkret mbajn\u00eb p\u00ebrgjegj\u00ebsi p\u00ebr keqp\u00ebrdorim t\u00eb pozit\u00ebs zyrtare, ku ndaj tyre duhet t\u00eb merren masa ndeshkuese, sepse veprimi i tyre \u00ebsht\u00eb kund\u00ebr barazis\u00eb qytetare e nacionale t\u00eb pjes\u00ebtar\u00ebve t\u00eb shqiptar\u00ebve n\u00eb Mal t\u00eb Zi.<\/p>\n

Flamuri komb\u00ebtar shqiptar dhe jo flamuri i nj\u00eb shteti tjet\u00ebr<\/strong><\/p>\n

Edhe pse p\u00ebr k\u00ebt\u00eb rast ka pasur reagime nga disa subjektet politike shqiptare e jo nga ata t\u00eb ashtuquajtura qytetare, \u00ebsht\u00eb konstatim i p\u00ebrgjithsh\u00ebm se rastet e tilla na rikthejn\u00eb n\u00eb t\u00eb kaluar\u00ebn, n\u00eb koh\u00ebn kur flamuri komb\u00ebtar shqiptar ishte i ndaluar nga pushteti i koh\u00ebs (1982-2000). Arsyetimi policor se kemi t\u00eb b\u00ebjm\u00eb me simbolin e nj\u00eb shteti tjet\u00ebr, \u00ebsht\u00eb shpjegim demagogjik si n\u00eb koh\u00ebn e monizmit, duke harruar se jetojm\u00eb n\u00eb pluraliz\u00ebm.<\/p>\n

Nj\u00eb deklarim i till\u00eb d\u00ebshmon se ata nuk kan\u00eb njohuri se \u00ebsht\u00eb n\u00eb funksion Ligji p\u00ebr p\u00ebrdorimin e simbol\u00ebve komb\u00ebtare, dhe se nuk dallojn\u00eb simbolin komb\u00ebtar me ate shtet\u00ebror, duke d\u00ebshmuar injoranc\u00ebn e tyre, sepse shqiptar\u00ebt kudo q\u00eb jan\u00eb kan\u00eb nj\u00eb simbol komb\u00ebtar, pavar\u00ebsisht s\u00eb n\u00eb cil\u00ebt shtete jetojn\u00eb.<\/p>\n

Kur shteti nuk nderon qytetar\u00ebt e vet<\/strong><\/p>\n

N\u00eb nj\u00eb shtet demokratik qytetar\u00ebt e tij jan\u00eb t\u00eb barabart\u00eb dhe si t\u00eb till\u00eb trajtohen nga institucionet shtet\u00ebrore, jo vet\u00ebm me deklarata t\u00eb rastit por me veprime konkrete duke zbatuar n\u00eb praktik\u00eb barazin\u00eb qytetare dhe nacionale. Vet\u00ebm shtetet e pakonsoliduara dhe ato me paragjykime nga e kaluara moniste jan\u00eb me komplekse dhe e kan\u00eb t\u00eb v\u00ebshtir\u00eb t\u00eb jen\u00eb n\u00eb hap me koh\u00ebn dhe demokracin\u00eb europiane. Madje ka edhe t\u00eb till\u00eb, t\u00eb cil\u00ebt nuk realizojn\u00eb n\u00eb praktik\u00eb as ligjet, t\u00eb cil\u00ebt i miratojn\u00eb vet\u00eb si dhe standard\u00ebt nd\u00ebrkomb\u00ebtare kur jan\u00eb n\u00eb pyetje mjediset multinacionale, ku n\u00eb k\u00ebt\u00eb aspekt as Mali i Zi nuk b\u00ebn p\u00ebrjashtim.<\/p>\n

Veprimet e tilla policore, kur \u00ebsht\u00eb n\u00eb pyetje simboli komb\u00ebtar nuk jan\u00eb personale por ka t\u00eb b\u00ebj\u00eb me t\u00eb gjith\u00eb shqiptar\u00ebt, andaj nj\u00eb veprim i till\u00eb \u00ebsht\u00eb goditje e t\u00eb drejtave kolektive t\u00eb shqiptar\u00ebve n\u00eb Mal t\u00eb Zi, q\u00eb \u00ebsht\u00eb n\u00eb kund\u00ebrshtim flagrant me Kushtetut\u00ebn dhe kund\u00ebr barazis\u00eb qytetare dhe nacionale.<\/p>\n

N\u00ebse do t\u00eb vazhdohet me k\u00ebt\u00eb politik\u00eb diskriminuese ndaj simbolit ton\u00eb komb\u00ebtar nuk \u00ebsht\u00eb \u00e7udi q\u00eb polici t\u00eb ndaloj\u00eb, n\u00ebse do t\u00eb hetoj\u00eb simbolin komb\u00ebtar shqiptar n\u00eb makin\u00eb, apo n\u00eb rroba e gjetiu q\u00eb do t\u00eb ishte skandal me regji shtet\u00ebrore.<\/p>\n

Mbetet t\u00eb shohim se \u00e7far\u00eb ndryshimi n\u00eb k\u00ebt\u00eb aspekt (neni 23) do t\u00eb ket\u00eb Ligji p\u00ebr qet\u00ebsi e rend publik, kur \u00ebsht\u00eb n\u00eb pyetje p\u00ebrdorimi i simboleve komb\u00ebtare p\u00ebr popujt pakic\u00eb n\u00eb Mal t\u00eb Zi, i cili b\u00ebh\u00ebt me dije se do t\u00eb jet\u00eb n\u00eb procedur\u00eb parlamentare deri n\u00eb fund t\u00eb k\u00ebtij viti.<\/p>\n
