XHABIR ZEJNUNI<\/strong><\/p>\n<p>Pro\u00e7esi i \u201cdjegjes\u201d s\u00eb mandateve t\u00eb opozit\u00ebs dhe kthimi i tyre n\u00eb popull (i opozit\u00ebs dhe i mandateve!), u konsideruan: si nj\u00eb risi shqiptare; si nj\u00eb ngjarje historike; si kalimi n\u00eb nj\u00eb epok\u00eb t\u00eb re; si fillimi i fundit t\u00eb regjimit gjakatar t\u00eb satrapit Rama; si shprehja e vullnetit t\u00eb lir\u00eb t\u00eb popullit \u201csovran\u201d, etj.<\/p>\n<p>Dihet tashm\u00eb se vendimi i \u201cdjegjes\u201d s\u00eb mandateve u mor nga krer\u00ebt e opozit\u00ebs (1+1+2!), por pa u k\u00ebshilluar ata m\u00eb par\u00eb me baz\u00ebn e partive opozitare, me kandidat\u00ebt e list\u00ebs dhe me popullin \u201csovran\u201d! U supozua se k\u00ebsaj \u201cdjegjeje\u201d do i n\u00ebshtroheshin edhe kandidat\u00ebt e list\u00ebs prit\u00ebse. Arsyet(imet) ishin t\u00eb natyrave t\u00eb ndryshme, si: mandatet jan\u00eb t\u00eb Partis\u00eb; kush pranon mandatin \u00ebsht\u00eb tradh\u00ebtar i idealeve t\u00eb larta t\u00eb Partis\u00eb dhe popullit \u201csovran\u201d; kush pranon mandatin \u00ebsht\u00eb mercenar q\u00eb shitet p\u00ebr 30 aspra tek satrapi Rama; kandidat\u00ebt e list\u00ebs prit\u00ebse nuk e kan\u00eb formimin e duhur teknik, politik dhe ideologjik p\u00ebr t\u00eb p\u00ebrballuar ngarkes\u00ebn dhe presionin e madh t\u00eb pozit\u00ebs n\u00eb Parlament; p\u00ebrfaq\u00ebsimi i kandidat\u00ebve t\u00eb list\u00ebs prit\u00ebse n\u00eb Parlament \u00ebsht\u00eb nj\u00eb falsitet etj.<\/p>\n<p>Por, nuk ndodhi k\u00ebshtu, pasi ndonj\u00eb deputet nuk e \u201cdogji\u201d mandatin e tij dhe shum\u00eb kandidat\u00eb t\u00eb list\u00ebs prit\u00ebse po hyjn\u00eb n\u00eb Parlament!<br \/>\nProblemi kryesor tani \u00ebsht\u00eb se kujt\u00eb i takon mandati, ose kush \u00ebsht\u00eb TITULLARI REAL (ose \u201cpronari\u201d!) i mandatit, i cili ka m\u00eb pas tag\u00ebr q\u00eb t\u2019ja akordoj\u00eb at\u00eb personave t\u00eb caktuar.<\/p>\n<p>\u00cbsht\u00eb populli apo Partia?<br \/>\nA kan\u00eb t\u00eb drejt\u00eb t\u00eb hyjn\u00eb n\u00eb Parlament kandidat\u00ebt e list\u00ebs prit\u00ebse, pavar\u00ebsisht arsyeve (edhe t\u00eb \u201cpaparashikuara\u201d!) t\u00eb krijimit t\u00eb pavlefshm\u00ebris\u00eb s\u00eb mandatit?<\/p>\n<p>Kushtetuta tek neni 70, par. 1, disponon se \u201cDeputet\u00ebt p\u00ebrfaq\u00ebsojn\u00eb popullin dhe nuk lidhen me asnj\u00eb mandat detyrues\u201d. Q\u00eb deputet\u00ebt \u201cnuk lidhen me asnj\u00eb mandat detyrues\u201d, u pa konkretisht me disa deputet\u00eb t\u00eb cil\u00ebt vazhduan mandatin e tyre!<\/p>\n<p>N\u00ebse deputet\u00ebt \u201cp\u00ebrfaq\u00ebsojn\u00eb popullin\u201d, at\u00ebher\u00eb do thot\u00eb q\u00eb ata nuk p\u00ebrfaq\u00ebsojn\u00eb Partin\u00eb, edhe pse kjo parti i ka futur ata n\u00eb list\u00ebn e kandidimit. E nj\u00ebjta gj\u00eb ndodh at\u00ebher\u00eb edhe me kandidat\u00ebt e list\u00ebs prit\u00ebse, t\u00eb cil\u00ebt n\u00eb baz\u00eb t\u00eb Kodit Zgjedhor kan\u00eb t\u00eb drejt\u00eb q\u00eb t\u00eb z\u00ebvend\u00ebsojn\u00eb deputet\u00ebt q\u00eb p\u00ebr arsye t\u00eb ndryshme nd\u00ebrpresin mandatin e tyre (p\u00ebrfshir\u00eb edhe \u201cdjegjen\u201d e mandatit!).<\/p>\n<p>T\u00eb ngulmosh kaq shum\u00eb q\u00eb kandidat\u00ebt e list\u00ebs prit\u00ebse nuk duhet t\u00eb hyjn\u00eb n\u00eb Parlament, t\u00eb krijon iden\u00eb se vet\u00ebm deputet\u00ebt q\u00eb \u201cdogj\u00ebn\u201d mandatin e tyre, jan\u00eb t\u00eb paz\u00ebvend\u00ebsuesh\u00ebm dhe se \u201cflijimi\u201d i tyre n\u00eb altarin e demokracis\u00eb, sh\u00ebrben si nj\u00eb garanci q\u00eb ata t\u00eb jen\u00eb p\u00ebrs\u00ebri n\u00eb list\u00ebn e ardhshme. Kjo histori na kujton koh\u00ebn e an\u00ebtar\u00ebve t\u00eb dikursh\u00ebm t\u00eb Byros\u00eb Politike, t\u00eb cil\u00ebt rrinin me dekada n\u00eb postin e tyre. Dihet edhe rezultati i pun\u00ebs s\u00eb tyre!<\/p>\n<p>T\u2019i mohosh kandidat\u00ebve t\u00eb list\u00ebs prit\u00ebse p\u00ebrfaq\u00ebsimin e popullit \u201csovran\u201d n\u00eb Parlament, sjell q\u00eb t\u00eb delegjitimosh vet\u00eb Partin\u00eb propozuese.<\/p>\n<p>N\u00eb lidhje me nd\u00ebrprerjen e mandatit, Kodi Zgjedhor tek neni 164 me titull \u201cNd\u00ebrprerja e mandatit dhe z\u00ebvend\u00ebsimi i vakanc\u00ebs\u201d, tek par. 1, disponon se \u201cMandati i deputetit, i fituar sipas neneve 162 dhe 163 t\u00eb k\u00ebtij Kodi, nd\u00ebrpritet vet\u00ebm p\u00ebr shkaqet e parashikuara n\u00eb nenin 71 t\u00eb Kushtetut\u00ebs. Nuk p\u00ebrb\u00ebjn\u00eb shkak p\u00ebr nd\u00ebrprerje t\u00eb mandatit marr\u00ebveshjet apo deklaratat paraprake individuale apo kolektive p\u00ebr heqje dor\u00eb nga mandati\u201d.<\/p>\n<p>Por, \u201cdjegja\u201d e mandatit, nuk parashikohet n\u00eb nenin 71 t\u00eb Kushtetut\u00ebs. Dhe \u201cmarr\u00ebveshja apo deklarata paraprake individuale apo kolektive p\u00ebr heqje dor\u00eb nga mandati\u201d, n\u00eb rastin konkret u kthye n\u00eb \u201cdjegje\u201d mandatesh! Kjo sjell q\u00eb pasojat duhet t\u2019i marrin p\u00ebrsip\u00ebr vet\u00ebm ata persona q\u00eb \u201cdogj\u00ebn\u201d mandatin dhe jo kandidat\u00ebt e list\u00ebs, t\u00eb cil\u00ebt kan\u00eb t\u00eb drejt\u00ebn kushtetuese dhe ligjore t\u00eb vazhdim\u00ebsis\u00eb s\u00eb p\u00ebrfaq\u00ebsimit t\u00eb elektoratit t\u00eb tyre n\u00eb Parlament.<br \/>\nTermi PARTI ka p\u00ebrcaktime t\u00eb ndryshme juridike dhe filozofike.<\/p>\n<p>Kemi p\u00ebrcaktimin marksist-leninist, i cili thot\u00eb se \u201cPartit\u00eb jan\u00eb pjesa m\u00eb e nd\u00ebrgjegshme e nj\u00eb klase (popullit), e cila shpreh dhe mbron interesat e k\u00ebsaj klase (popullit)\u201d. P\u00ebrcaktim m\u00eb se demagogjik.<\/p>\n<p>Por, p\u00ebrcaktimi m\u00eb i sakt\u00eb dhe m\u00eb i pranuesh\u00ebm q\u00eb i b\u00ebhet partive, \u00ebsht\u00eb ai i filozofit Max Weber, i cili thot\u00eb se \u201cPartit\u00eb jan\u00eb fondacione me nj\u00eb pjes\u00ebmarrje t\u00eb lir\u00eb, q\u00eb krijohen me q\u00ebllim atribuimi krer\u00ebve t\u00eb saj t\u00eb nj\u00eb pozicioni pushteti brenda nj\u00eb grupi social dhe militant\u00ebve aktiv\u00eb mund\u00ebsin\u00eb e ndjekjes s\u00eb q\u00ebllimeve objektive, ose p\u00ebr ndjekjen e avantazheve personale, ose p\u00ebr t\u00eb dyja q\u00ebllimet\u201d.<\/p>\n<p>N\u00eb fakt, kandidat\u00ebt p\u00ebr deputet\u00eb propozohen nga Kryetari i Partis\u00eb me list\u00ebn e tij (n\u00eb respektim t\u00eb nenit 64, par. 1 t\u00eb Kushtetut\u00ebs).<\/p>\n<p>Kandidaturat e deputet\u00ebv\u00eb, n\u00eb baz\u00eb t\u00eb nenit 68, par. 1, \u201cMund t\u00eb paraqiten vet\u00ebm nga partit\u00eb politike, nga koalicionet e partive, si dhe nga zgjedh\u00ebsit\u201d. Por, t\u00eb gjith\u00eb e dim\u00eb se si p\u00ebrfundon paraqitja e kandidaturave p\u00ebr deputet\u00eb nga \u201czgjedh\u00ebsit\u201d, ose nga populli \u201csovran\u201d!<\/p>\n<p>M\u00eb pas, k\u00ebta deputet\u00eb edhe pse jan\u00eb paraqitur nga \u201cpartit\u00eb politike, nga koalicionet e partive\u201c, ata p\u00ebrfaq\u00ebsojn\u00eb popullin (n\u00eb respektim t\u00eb nenit 70, par. 1 t\u00eb Kushtetut\u00ebs).<br \/>\nN\u00eb k\u00ebt\u00eb rast, nuk ka pse t\u00eb b\u00ebj\u00eb p\u00ebrjashtim as edhe lista prit\u00ebse me kandidat\u00ebt m\u00eb t\u00eb mir\u00eb, e cila p\u00ebrpilohet nga Kryetari i Partis\u00eb.<\/p>\n<p>Si rezultat, rrjedh se titullaritetin e mandatit e ka populli, nd\u00ebrsa \u201cpron\u00ebsin\u00eb\u201d e mandatit e ka Partia.<br \/>\nOse m\u00eb sakt\u00eb, Kryetari i saj.<br \/>\nKush ka t\u00eb drejt\u00eb k\u00ebtu(\u2026.)?!<\/p>\n","protected":false},"excerpt":{"rendered":"<p>AV.
