Por, Hasani ka th\u00ebn\u00eb se presidenti ka nd\u00ebrmarr\u00eb veprim jokushtetues, duke th\u00ebn\u00eb se \u201c<em>t\u00eb drejtat kushtetuese nuk mund t\u00eb n\u00ebnkuptohen se jan\u00eb braktisur nga titullari dhe nuk mund t\u00eb paragjykohet veprimi i titullarit, n\u00eb k\u00ebt\u00eb rast fituesit t\u00eb zgjedhjeve, sepse \u00ebsht\u00eb jokushtetuese<\/em>\u201d.<\/p>\n<p><strong>Profesor Hasani, si e shihni ju afatin kushtetues p\u00ebr partin\u00eb fituese t\u00eb zgjedhjeve p\u00ebr propozimin e mandatarit p\u00ebr formimin e qeveris\u00eb, duke iu referuar edhe letr\u00ebs s\u00eb fundit t\u00eb presidentit Hashim Tha\u00e7i, ku thuhet se partia fituese nuk e shfryt\u00ebzoi t\u00eb drejt\u00ebn e vet?<\/strong><\/p>\n<p><strong>Enver Hasani<\/strong>: N\u00eb Kushtetut\u00ebn ton\u00eb nuk ka nj\u00eb afat t\u00eb till\u00eb, por m\u00eb lejoni t\u00eb them se nj\u00eb afat t\u00eb till\u00eb nuk e kan\u00eb edhe shumica e kushtetutave, q\u00eb jan\u00eb demokraci kushtetuese parlamentare, sepse supozohet q\u00eb vullneti politik gjithmon\u00eb, p\u00ebrmes kompromiseve dhe k\u00ebshtu me radh\u00eb, arrihet deri t\u00eb nj\u00eb fillim i nj\u00eb procedure. N\u00eb k\u00ebt\u00eb drejtim, do t\u00eb thot\u00eb, Kosova nuk \u00ebsht\u00eb vet\u00ebm, sepse ky standard ekziston edhe n\u00eb kushtetuta t\u00eb tjera, pra q\u00eb cakton nj\u00eb afat, sepse nuk mund t\u00eb diktohet p\u00ebrmes afateve, se kur nis\u00eb, sepse supozohet q\u00eb afatet rrjedhin p\u00ebrmes vullnetit politik t\u00eb aktor\u00ebve politik\u00eb n\u00eb nj\u00eb shtet.<\/p>\n<p><strong>Po veprimin e sot\u00ebm t\u00eb presidentit Tha\u00e7i, si e shihni at\u00eb?<\/strong><\/p>\n<p><strong>Enver Hasani<\/strong>: Kjo q\u00eb ka b\u00ebr\u00eb presidenti, kjo n\u00ebnkupton q\u00eb <strong>presidenti ka b\u00ebr\u00eb gabim<\/strong>, sepse e ka marr\u00eb si t\u00eb mir\u00ebqen\u00eb dhe e ka paragjykuar mendimin e L\u00ebvizjes Vet\u00ebvendosje, duke e imagjinuar nj\u00eb afat, q\u00eb nuk ekziston dhe duke th\u00ebn\u00eb se meqen\u00ebse nuk po dor\u00ebzon em\u00ebr, n\u00eb nj\u00eb fat q\u00eb nuk ekziston, at\u00ebher\u00eb p\u00ebr pasoj\u00eb ti e ke humbur, e ke braktisur t\u00eb drejt\u00ebn t\u00ebnde kushtetuese. Kjo nuk shkon k\u00ebshtu sepse presidenti nuk mund t\u00eb caktoj\u00eb afate kushtetuese dhe presidenti nuk mund t\u00eb paragjykoj\u00eb dhe detyroj\u00eb forc\u00ebrisht braktisjen e garancioneve kushtetuese, q\u00eb i ka fituesi i zgjedhjeve.<\/p>\n<p><strong>At\u00ebher\u00eb a \u00ebsht\u00eb e pritshme q\u00eb Vet\u00ebvendosje t\u2019i drejtohet Gjykat\u00ebs Kushtetuese p\u00ebr aktgjykim?<\/strong><\/p>\n<p><strong>Enver Hasani<\/strong>: Tash nuk e di un\u00eb, n\u00ebse ajo (Vet\u00ebvendosje) do ta shfryt\u00ebzoj\u00eb apo jo, kjo \u00ebsht\u00eb \u00e7\u00ebshtje e procesit politik, por krejt logjike \u00ebsht\u00eb q\u00eb kjo pun\u00eb t\u00eb p\u00ebrfundoj\u00eb n\u00eb Gjykat\u00eb Kushtetuese.<\/p>\n<p><strong>Po nism\u00ebn e presidentit, q\u00eb t\u00eb filloj\u00eb me raundin e dyt\u00eb t\u00eb bisedimeve me lider\u00ebt politik\u00eb, a e shihni t\u00eb bazuar n\u00eb aktgjykimin e Gjykat\u00ebs Kushtetuese t\u00eb vitit 2014?<\/strong><\/p>\n<p><strong>Enver Hasani<\/strong>: Un\u00eb e pash letr\u00ebn e presidentit Tha\u00e7i dhe ai po thirret n\u00eb Kushtetut\u00eb dhe n\u00eb vendimin e Gjykat\u00ebs Kushtetuese t\u00eb vitit 2014, nd\u00ebrkoh\u00eb q\u00eb veprimet jan\u00eb krejt t\u00eb mbrapshta, si p\u00ebr at\u00eb q\u00eb ka b\u00ebr\u00eb sot, ashtu edhe me letrat tjera.<\/p>\n<p>Vendimi i Gjykat\u00ebs Kushtetuese t\u00eb vitit 2014 k\u00ebrkon nj\u00eb procedur\u00eb q\u00eb \u00ebsht\u00eb jasht\u00ebzakonisht e qart\u00eb si loti, sepse aty k\u00ebrkohet q\u00eb n\u00eb raundin e par\u00eb, kurdo qoft\u00eb, p\u00ebrcaktohet se si duhet t\u00eb formohet nj\u00eb qeveri, brenda nj\u00eb cikli zgjedhor dhe se procedurat jan\u00eb t\u00eb nj\u00ebjta dhe s\u2019ka asnj\u00eb dallim. Q\u00eb do t\u00eb thot\u00eb, n\u00eb raundin e par\u00eb presidenti ka zero diskrecion dhe ai vet\u00ebm duhet t\u00eb shikoj\u00eb se si vet\u00eb t\u00eb formohet vullneti politik n\u00eb mes forcave politike. \u00c7do let\u00ebr q\u00eb ka d\u00ebrguar deri m\u00eb tani, jo vet\u00ebm tash, por edhe ato pas zgjedhjeve t\u00eb 6 tetorit, kur \u00ebsht\u00eb formuar Qeveria Kurti, kan\u00eb qen\u00eb paragjykuese, sepse nuk i takon presidentit t\u00eb Republik\u00ebs, q\u00eb n\u00eb m\u00ebnyr\u00eb arbitrare t\u00eb ndaj\u00eb apo t\u00eb b\u00ebj\u00eb presion p\u00ebr dh\u00ebnien ose marrjen e mandateve.<\/p>\n<p>Ky e ka nis\u00eb her\u00ebn e dyt\u00eb, q\u00eb ka qen\u00eb edhe m\u00eb mbrapsht, ka nis\u00eb konsultimet me partit\u00eb tjera, si\u00e7 e ka th\u00ebn\u00eb edhe n\u00eb letrat e tij, nd\u00ebrkoh\u00eb q\u00eb paralel me k\u00ebt\u00eb, n\u00eb Vet\u00ebvendosje ka d\u00ebrguar sa p\u00ebr sy e faqe, duke besuar gabimisht se po plot\u00ebson kushtin kushtetues, q\u00eb t\u2019i drejtohet fituesit t\u00eb zgjedhjeve.<\/p>\n<p>Procedura e rregullt \u00ebsht\u00eb kjo \u2013 i drejtohesh dhe e ezauron deri n\u00eb fund me fituesin e zgjedhjeve dhe ajo (partia fituese) duhet q\u00eb n\u00eb m\u00ebnyr\u00eb pa ekuivoke, pa dykuptim\u00ebsi, ta b\u00ebj\u00eb me dije, n\u00ebse do ta shfryt\u00ebzon t\u00eb drejt\u00ebn e vet ose jo, pa paragjykime. T\u00eb drejtat kushtetuese nuk mund t\u00eb n\u00ebnkuptohen se jan\u00eb braktisur nga titullari dhe nuk mund t\u00eb paragjykohet veprimi i titullarit, n\u00eb k\u00ebt\u00eb rast fituesit t\u00eb zgjedhjeve, sepse \u00ebsht\u00eb jokushtetuese. <strong><em>Me k\u00ebto veprime presidenti ka b\u00ebr\u00eb dirigjimin e form\u00ebsimit t\u00eb vullnetit politik dhe po synon komandimin e atij vullneti politik n\u00eb m\u00ebnyr\u00eb jo t\u00eb rregullt dhe jokushtetuese.<\/em><\/strong><\/p>\n<p><strong>Po si t\u00eb veprohet n\u00eb rastin, kur partia fituese nuk e shfryt\u00ebzon t\u00eb drejt\u00ebn e vet p\u00ebr propozimin e mandatarit?<\/strong><\/p>\n<p><strong>Enver Hasani<\/strong>: Un\u00eb nuk e di se \u00e7far\u00eb kan\u00eb n\u00eb kok\u00eb lideri i Vet\u00ebvendosjes dhe t\u00eb tjer\u00ebt, por ata me letrat q\u00eb i kan\u00eb b\u00ebr\u00eb publike nuk po thon\u00eb se nuk do ta d\u00ebrgojn\u00eb (emrin e mandatarit). Ata po thon\u00eb se do ta d\u00ebrgoj\u00eb dhe do ta informojn\u00eb n\u00eb m\u00ebnyr\u00eb p\u00ebrkat\u00ebse presidentin e Republik\u00ebs dhe do t\u2019i ndjekin procedurat. N\u00eb baz\u00eb t\u00eb asaj q\u00eb \u00ebsht\u00eb th\u00ebn\u00eb, nuk mund t\u00eb nxirret se Vet\u00ebvendosje nuk d\u00ebshiron ta shfryt\u00ebzoj\u00eb k\u00ebt\u00eb t\u00eb drejt\u00eb.
