{"id":65144,"date":"2021-03-05T04:47:28","date_gmt":"2021-03-05T03:47:28","guid":{"rendered":"https:\/\/fjala.info\/?p=65144"},"modified":"2021-03-05T04:47:28","modified_gmt":"2021-03-05T03:47:28","slug":"sistem-presidencial-per-dalje-nga-carku-i-mbyllur-politik","status":"publish","type":"post","link":"https:\/\/jehonashqiptare.al\/fjala\/sistem-presidencial-per-dalje-nga-carku-i-mbyllur-politik\/","title":{"rendered":"Sistem presidencial per dalje nga \u00e7arku i mbyllur politik!"},"content":{"rendered":"<p>Shkruan: <strong>Florim Zeqa<\/strong> <em>04.03.2021<\/em><\/p>\n<p><em>Pas rezultatit zgjedhor askush nuk ka t\u00eb drejt\u00eb ta kontestoj dhe as nuk mund ta pengoj zgjedhjen e Albin Kurtit kryeminist\u00ebr t\u00eb ri t\u00eb shtetit t\u00eb Kosov\u00ebs, pasi k\u00ebt\u00eb ia mund\u00ebsuan qytetar\u00ebt e vendit ton\u00eb me vot\u00ebn e lir\u00eb dhe demokratike n\u00eb zgjedhjet e 14 shkurtit 2021.<\/em><\/p>\n<p><strong>Konsensus politik p\u00ebr zgjedhjen e presidentit (tes)<\/strong><\/p>\n<p>K\u00ebshtu duhej t\u00eb ndodhte edhe p\u00ebr zonj\u00ebn m\u00eb t\u00eb votuar n\u00eb Kosov\u00eb, por sa i p\u00ebrket zgjedhjes s\u00eb presidentit e kemi nj\u00eb situat\u00eb pak m\u00eb t\u00eb nd\u00ebrlikuar.<\/p>\n<p>Edhe p\u00ebrkund\u00ebr legjitimitetit t\u00eb lart\u00eb qytetar, zgjedhja e zonjes Vjosa Osmani n\u00eb postin e presidentes k\u00ebrkon konsensus m\u00eb t\u00eb gj\u00ebr\u00eb mes forcave politike n\u00eb Kuvendin e Republik\u00ebs s\u00eb Kosov\u00ebs dhe se sistemi aktual qeveris\u00ebs dhe kushtetuta e vendit nuk i mund\u00ebsojn\u00eb zgjedhjen si presidente nga vota popullore.<\/p>\n<p>\u00c7do tendenc\u00eb e abuzimit me rezultatin zgjedhor n\u00eb em\u00ebr t\u00eb votes popullore p\u00ebr zgjedhjen e presidentit mund ta \u00e7oj\u00eb vendin drejt nj\u00eb kriz\u00eb t\u00eb re politike, e cila mund t\u00eb prodhoj\u00eb destabilitet dhe zgjedhje t\u00eb nj\u00ebpasnj\u00ebshme.<\/p>\n<p>Pa ndryshimin e kushtetut\u00ebs nuk mund t\u00eb kemi sistem elektoral q\u00eb e mund\u00ebson zgjedhjen e presidentit drejt\u00ebp\u00ebrdrejt nga vota popullore.<br \/>\nThirrja ime n\u00eb shkrimin e fundit p\u00ebr heqje dor\u00eb t\u00eb Vjosa Osmanit nga posti i presidentit p\u00ebr t\u00eb mir\u00ebn e vendit, nuk ka t\u00eb b\u00ebj\u00eb me preferenca personale por me \u00e7asje pragmatike.<\/p>\n<p>Bazuar n\u00eb kompetencat e kufizuara t\u00eb presidentit si rrjedhoj\u00eb kufizimeve kushtetuese dhe sistemit politik, konsideroj se Vjosa Osmani m\u00eb e dobishme p\u00ebr shtetin do t\u00eb ishte n\u00eb cilin do post tjet\u00ebr politik sesa n\u00eb at\u00eb t\u00eb presidentit deri n\u00eb ndryshimin e Kushtetut\u00ebs apo kalimin n\u00eb sistem presidencial t\u00eb qeverisjes.<\/p>\n<p><strong>Ndryshimi i sisetmit elektoral, hap\u00eb rrug\u00ebn e ndryshimit t\u00eb sistemit politik<\/strong><\/p>\n<p>Ndryshimi i sistemit elektoral do ta ndryshonte rr\u00ebnj\u00ebsisht edhe sistemin qeveris\u00ebs n\u00eb vendin ton\u00eb. Vet\u00ebm kalimi nga sistemi parlamentar n\u00eb at\u00eb presidencial do t&#8217;i krijonte premisat e nj\u00eb qeverisje stabile dhe demokratike n\u00eb vendin ton\u00eb.<\/p>\n<p>Sistemi Presidencial dhe zgjedhja e presidentit t\u00eb shtetit drejt\u00ebp\u00ebrdrejt nga populli (ide e kahmotshme e presidentit historik Ibrahim Rugova) do t\u2019u jepte fund bllokadave paszgjedhore dhe m\u00ebnyr\u00ebs s\u00eb kontrabandimit t\u00eb postit t\u00eb presidentit t\u00eb shtetit nga partit\u00eb politike.<\/p>\n<p>Ndryshimi i Kushtetut\u00ebs, p\u00ebrkat\u00ebsisht i ligjit dhe akteve n\u00ebnligjore q\u00eb mund\u00ebsojn\u00eb reform\u00ebn e mir\u00ebfillt\u00eb zgjedhore p\u00ebr kalimin nga sistemi parlamentar n\u00eb at\u00eb presidencial, i cili p\u00ebrveqse imperativ i ngutsh\u00ebm kohor\u00eb, ka si mbetur e vetmja zgjidhje p\u00ebr nxjerrjen e vendit nga kolapsi i nj\u00eb sistemi t\u00eb d\u00ebshtuar qeveris\u00ebs 22 vje\u00e7ar\u00eb.<\/p>\n<p>Sistemi presidencial paraqet \u00e7el\u00ebsin e evitimit t\u00eb ng\u00ebr\u00e7eve politike dhe krizave artificiale paszgjedhore t\u00eb paraqitura n\u00eb m\u00ebnyr\u00eb serike n\u00eb Kosov\u00ebn e pasluft\u00ebs!<br \/>\nSistemi presidencial automatikisht krijon premisat e dy blloqeve t\u00eb forta parazgjedhore, respektivisht bipolarizimin e sken\u00ebs politike me krijimin e krahut t\u00eb djatht\u00eb dhe atij t\u00eb majt\u00eb politik.<\/p>\n<p>P\u00ebrderisa n\u00eb sistemin parlamentar mund\u00ebsia e manipulimit me zgjedhjet \u00ebsht\u00eb jasht\u00ebzakonisht e madhe, n\u00eb sistemin presidencial zvog\u00eblohet n\u00eb minimum ajo mund\u00ebsi, pasi vota e sovranit (qytetarit) \u00ebsht\u00eb e drejt\u00ebp\u00ebrdrejt\u00eb dhe vendimtare n\u00eb p\u00ebrcaktimin e kaheve qeveris\u00ebse t\u00eb vendit.<\/p>\n<p><strong>Republika parlamentare, d\u00ebshtim i demokracis\u00eb<\/strong><\/p>\n<p>Sisemi parlamentar, gjegj\u00ebsisht republikat parlamentare nuk jan\u00eb treguar t\u00eb suksesshme n\u00eb zgjidhjen e krizave politike paszgjedhore shkaku i polarizimit t\u00eb skajsh\u00ebm t\u00eb sken\u00ebs politike.<\/p>\n<p>Probleme t\u00eb k\u00ebsaj natyre jan\u00eb shfaqur dhe po vazhdojn\u00eb t\u00eb manifestohen kriza t\u00eb thella paszgjedhore edhe n\u00eb shtetet m\u00eb t\u00eb zhvilluara si; Gjermania, Italia, etj, e t\u00eb mos flasim p\u00ebr Kosov\u00ebn me nj\u00eb demokraci t\u00eb brisht\u00eb parlamentare.<\/p>\n<p>Jo vet\u00ebm p\u00ebr zgjedhjen e presidentit drejt\u00ebp\u00ebrdrejt nga populli, por edhe p\u00ebr shum\u00eb arsye t\u00eb tjera, legjislatura e re e Kuvendit t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs e ka p\u00ebr detyr\u00eb t\u00eb themeloj\u00eb nj\u00eb komision t\u00eb pavarur parlamentar, t\u00eb p\u00ebrb\u00ebr nga ekspert t\u00eb fush\u00ebs juridike p\u00ebr t\u00eb ridizajnuar kushtetut\u00ebn e vendit konform\u00eb k\u00ebrkesave t\u00eb koh\u00ebs, p\u00ebr \u00e7uarjen para t\u00eb reformave dhe proceseve demokratike.<\/p>\n<p><strong>&#8216;Pakoja e Ahtisarit&#8217; e tejkaluar p\u00ebr rrethanat e koh\u00ebs<\/strong><\/p>\n<p>Kushtetuta aktuale e bazuar n\u00eb t\u00eb ashtuquajtur\u00ebn \u201cPako e Ahtisarit\u201d, \u00ebsht\u00eb b\u00ebr\u00eb penges\u00eb e vendimarrjes n\u00eb Kuvend. Kthimi i referendumit n\u00eb Kushtetut\u00ebn e Republik\u00ebs s\u00eb Kosov\u00ebs, si instrumentin m\u00eb demokratik p\u00ebr zgjidhjen e problemeve madhore (ndryshimeve kapitale p\u00ebr vendin) dhe dryshimi i ligjit p\u00ebr heqjen e vot\u00ebs s\u00eb dyfisht (vetos) t\u00eb serb\u00ebve n\u00eb parlament do t&#8217;i largonte p\u00ebrfundimisht vargonj\u00ebt serb nga qafa e Kosov\u00ebs.<\/p>\n<p>P\u00ebr m\u00eb shum\u00eb se kaq, Kosova, \u201cDe Jure\u201d dhe \u201cDe Facto\u201d do ta merrte form\u00ebn e shtetit sovran. Me kalimin n\u00eb sistemin presidencial n\u00eb nj\u00ebr\u00ebn an\u00eb dhe modernizimin e Forcave t\u00eb Armatosura t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs n\u00eb an\u00ebn tjet\u00ebr, shteti yn\u00eb do t\u00eb b\u00ebhej partner i fuqish\u00ebm politik dhe ushtarak i Aleanc\u00ebs Veriatlantike, p\u00ebrkat\u00ebsisht NATO-s dhe SHBA-s\u00eb, si garantuesin m\u00eb t\u00eb fuqish\u00ebm t\u00eb liris\u00eb dhe pavar\u00ebsis\u00eb s\u00eb shtetit ton\u00eb.<\/p>\n<p>P\u00ebrfundimisht, sistemi presidencial i qeverisjes s\u00eb vendit, do ta nxjerrte Kosov\u00ebn nga \u201c\u00e7arku i mbyllur\u201d politik.
